原標題:江蘇省總發布維權預警提示 防疫期間履行勞動合同應遵循誠實信用原則
江蘇省(sheng)總工會今天發布維權預警提示,提醒用人單(dan)位(wei)和職工,在當前重大(da)疫情條(tiao)件下,勞(lao)動合(he)同(tong)的(de)訂立、履(lv)行、變更、解(jie)除和終(zhong)止,應遵(zun)循誠實信用原則,可從以下3個方面(mian)依法履(lv)行勞(lao)動合(he)同(tong):
一是維持勞(lao)(lao)動關系穩定(ding),依法續(xu)(xu)(xu)(xu)(xu)延(yan)勞(lao)(lao)動合(he)(he)同(tong)。人(ren)社部此前明確規定(ding),防控疫(yi)情期(qi)間,對(dui)于(yu)隔離(li)治療(liao)、醫學(xue)觀察或其他緊急措施,不(bu)能(neng)(neng)到(dao)(dao)崗(gang)勞(lao)(lao)動的(de)職工,企業(ye)不(bu)得單方裁員,以保護(hu)勞(lao)(lao)動者切身利益。據此,用人(ren)單位(wei)應盡可能(neng)(neng)采取(qu)適當措施,保持勞(lao)(lao)動關系穩定(ding)。此外(wai),有(you)關部門因(yin)疫(yi)情實施隔離(li)、交(jiao)通管(guan)制等緊急措施,已被人(ren)社部要(yao)求按照合(he)(he)同(tong)法定(ding)續(xu)(xu)(xu)(xu)(xu)延(yan)情形對(dui)待(dai),合(he)(he)同(tong)到(dao)(dao)期(qi)的(de),不(bu)能(neng)(neng)終止勞(lao)(lao)動合(he)(he)同(tong),須續(xu)(xu)(xu)(xu)(xu)延(yan)至各種緊急措施結束為止。這就提醒用人(ren)單位(wei)和勞(lao)(lao)動者,注意及(ji)(ji)時溝通情況,及(ji)(ji)時辦(ban)理(li)續(xu)(xu)(xu)(xu)(xu)延(yan)勞(lao)(lao)動合(he)(he)同(tong)手續(xu)(xu)(xu)(xu)(xu)。合(he)(he)同(tong)到(dao)(dao)期(qi)尚未(wei)續(xu)(xu)(xu)(xu)(xu)簽的(de),要(yao)及(ji)(ji)時續(xu)(xu)(xu)(xu)(xu)簽。試用期(qi)到(dao)(dao)期(qi),未(wei)及(ji)(ji)時辦(ban)理(li)轉正手續(xu)(xu)(xu)(xu)(xu)的(de),要(yao)及(ji)(ji)時辦(ban)理(li)。
二是(shi)降低(di)(di)企(qi)業(ye)(ye)(ye)經(jing)營成(cheng)本,協商中(zhong)(zhong)止(zhi)履(lv)(lv)行合(he)同(tong)(tong)。根據《江蘇省勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)條(tiao)例(li)》有關規定(ding),企(qi)業(ye)(ye)(ye)與勞(lao)(lao)(lao)(lao)動(dong)者(zhe)中(zhong)(zhong)止(zhi)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong),需雙方協商一致。企(qi)業(ye)(ye)(ye)不(bu)能(neng)強迫(po)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)中(zhong)(zhong)止(zhi)履(lv)(lv)行勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)。對(dui)于因種種原因,長(chang)期(qi)(qi)難以復(fu)工的(de)(de)企(qi)業(ye)(ye)(ye),或者(zhe)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)因自身原因,長(chang)期(qi)(qi)無法返崗,均應向(xiang)對(dui)方充分說明情況,爭取理解和(he)支持單位短(duan)期(qi)(qi)中(zhong)(zhong)止(zhi)履(lv)(lv)行合(he)同(tong)(tong)、長(chang)期(qi)(qi)保持勞(lao)(lao)(lao)(lao)動(dong)關系的(de)(de)穩崗做(zuo)法。建議勞(lao)(lao)(lao)(lao)動(dong)者(zhe)與用(yong)人單位同(tong)(tong)舟共濟,共同(tong)(tong)幫助企(qi)業(ye)(ye)(ye)短(duan)期(qi)(qi)降低(di)(di)成(cheng)本,長(chang)期(qi)(qi)維持生產經(jing)營,共渡疫情難關。此后,待(dai)中(zhong)(zhong)止(zhi)情形消失,用(yong)人單位應及時恢(hui)復(fu)履(lv)(lv)行勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong),而不(bu)能(neng)將中(zhong)(zhong)止(zhi)履(lv)(lv)行合(he)同(tong)(tong)作為變相逼迫(po)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)離職的(de)(de)手段。
三是(shi)應(ying)對客觀環境變化,合(he)理變更勞(lao)動(dong)合(he)同。由于業(ye)務需要,在一(yi)(yi)定(ding)(ding)條(tiao)(tiao)件下(xia)(xia),用(yong)人(ren)單(dan)位(wei)可以對勞(lao)動(dong)合(he)同約定(ding)(ding)條(tiao)(tiao)件進行適當變更。《勞(lao)動(dong)合(he)同法》第三十五條(tiao)(tiao)第一(yi)(yi)款規定(ding)(ding),變更勞(lao)動(dong)合(he)同需要雙方協(xie)商一(yi)(yi)致。此次重大疫(yi)(yi)情環境下(xia)(xia),國(guo)(guo)家出(chu)臺不(bu)少政策,企(qi)業(ye)因受疫(yi)(yi)情影響(xiang)導致生產經營困(kun)難(nan)的,鼓勵企(qi)業(ye)采(cai)取調整薪(xin)酬、輪(lun)崗(gang)(gang)輪(lun)休(xiu)、縮短(duan)工(gong)時(shi)等(deng)方式穩(wen)崗(gang)(gang)調薪(xin)。同時(shi)國(guo)(guo)家也給(gei)予(yu)企(qi)業(ye)各種(zhong)穩(wen)崗(gang)(gang)補貼、金融支持。在此情況(kuang)下(xia)(xia),企(qi)業(ye)和職工(gong)都應(ying)當遵守《勞(lao)動(dong)合(he)同法》第四(si)條(tiao)(tiao)的規定(ding)(ding),積(ji)極協(xie)商,互(hu)相體諒,取得一(yi)(yi)致,對勞(lao)動(dong)合(he)同約定(ding)(ding)的崗(gang)(gang)位(wei)、工(gong)資、工(gong)作(zuo)時(shi)間(jian)等(deng)條(tiao)(tiao)件進行適當變更,采(cai)取時(shi)間(jian)上彈性工(gong)作(zuo)、地(di)點上居家辦公(gong)、作(zuo)息上輪(lun)崗(gang)(gang)輪(lun)休(xiu)等(deng)合(he)同短(duan)期(qi)變更方法,促(cu)進企(qi)業(ye)穩(wen)定(ding)(ding)工(gong)作(zuo)崗(gang)(gang)位(wei),靈(ling)活應(ying)對疫(yi)(yi)情造成的不(bu)利影響(xiang)。?(記者 王(wang)偉)
