國務院辦公廳關于推進公共資源配置領域
政府信息公開的意見

各(ge)省、自治區、直轄市(shi)人民政(zheng)府,國務院(yuan)各(ge)部委、各(ge)直屬機構(gou):
按照黨中央、國務(wu)(wu)院決策(ce)部署和《中共中央辦(ban)公(gong)(gong)廳 國務(wu)(wu)院辦(ban)公(gong)(gong)廳印(yin)發〈關于全面推進(jin)政務(wu)(wu)公(gong)(gong)開工作的意(yi)(yi)見(jian)〉的通(tong)知》等(deng)文件要求,為(wei)進(jin)一步(bu)推進(jin)公(gong)(gong)共資源配置領域(yu)政府信息(xi)公(gong)(gong)開,經國務(wu)(wu)院同意(yi)(yi),現提出(chu)如下意(yi)(yi)見(jian)。
一、指導思想
全(quan)(quan)面貫徹黨的(de)十(shi)九大(da)精神,堅(jian)持以習(xi)近平新時代(dai)中國特色(se)社(she)會(hui)主義思想(xiang)為指導,統籌(chou)推(tui)進(jin)“五位一體”總體布局(ju)和協調(diao)(diao)推(tui)進(jin)“四(si)個(ge)全(quan)(quan)面”戰略布局(ju),牢(lao)固樹立和貫徹落(luo)實(shi)(shi)創新、協調(diao)(diao)、綠(lv)色(se)、開放、共(gong)享的(de)發(fa)展理念,不斷推(tui)進(jin)國家治(zhi)理體系和治(zhi)理能力現(xian)代(dai)化,按照黨中央、國務(wu)(wu)院關于全(quan)(quan)面推(tui)進(jin)政務(wu)(wu)公開工作的(de)重要部署要求(qiu),推(tui)進(jin)公共(gong)資源(yuan)配置決(jue)策、執行、管理、服務(wu)(wu)、結果公開,擴大(da)公眾監督,增(zeng)強公開實(shi)(shi)效(xiao),努力實(shi)(shi)現(xian)公共(gong)資源(yuan)配置全(quan)(quan)流程(cheng)透(tou)明化,不斷提(ti)高公共(gong)資源(yuan)使用效(xiao)益(yi)(yi),維護企業和群眾合法權益(yi)(yi),為穩增(zeng)長、促(cu)(cu)改革、調(diao)(diao)結構、惠民生、防(fang)風險(xian)作出貢(gong)獻,促(cu)(cu)進(jin)經濟社(she)會(hui)持續健康發(fa)展。
二、主要任務
本(ben)意見(jian)所稱公共資(zi)源配(pei)置(zhi),主要(yao)包(bao)括保(bao)障性安(an)居工(gong)程(cheng)建設(she)、保(bao)障性住房分配(pei)、國有(you)土(tu)地(di)使(shi)用權(quan)和礦業(ye)權(quan)出讓(rang)、政府采購、國有(you)產權(quan)交易、工(gong)程(cheng)建設(she)項目(mu)招標投標等(deng)社會關注度高,具有(you)公有(you)性、公益性,對(dui)經濟社會發展、民(min)生(sheng)改善有(you)直接(jie)、廣泛和重(zhong)要(yao)影響(xiang)的公共資(zi)源分配(pei)事項。各地(di)區(qu)(qu)、各部門要(yao)根據區(qu)(qu)域、行業(ye)特(te)點,進一步明確本(ben)地(di)區(qu)(qu)、本(ben)行業(ye)公共資(zi)源配(pei)置(zhi)信息公開(kai)范圍,細化公開(kai)事項、內(nei)容(rong)、時(shi)限(xian)、方式、責任主體、監督(du)渠道等(deng),納(na)入主動公開(kai)目(mu)錄清單。
(一)突出公(gong)開重點。
1.住房保(bao)(bao)障領域。在(zai)項目建(jian)(jian)(jian)(jian)設(she)(she)方(fang)面,主(zhu)要公開(kai)城(cheng)鎮保(bao)(bao)障性(xing)安居工(gong)(gong)程(cheng)(cheng)規劃(hua)(hua)建(jian)(jian)(jian)(jian)設(she)(she)方(fang)案、年度建(jian)(jian)(jian)(jian)設(she)(she)計(ji)劃(hua)(hua)信(xin)(xin)息(xi)(xi)(包括(kuo)建(jian)(jian)(jian)(jian)設(she)(she)計(ji)劃(hua)(hua)任務量、計(ji)劃(hua)(hua)項目信(xin)(xin)息(xi)(xi)、計(ji)劃(hua)(hua)戶型(xing))、建(jian)(jian)(jian)(jian)設(she)(she)計(ji)劃(hua)(hua)完成(cheng)情(qing)況(kuang)(kuang)信(xin)(xin)息(xi)(xi)(包括(kuo)計(ji)劃(hua)(hua)任務完成(cheng)進度、已開(kai)工(gong)(gong)項目基(ji)(ji)本信(xin)(xin)息(xi)(xi)、已竣工(gong)(gong)項目基(ji)(ji)本信(xin)(xin)息(xi)(xi)、配套設(she)(she)施建(jian)(jian)(jian)(jian)設(she)(she)情(qing)況(kuang)(kuang))、農村(cun)危房改造(zao)相關政策(ce)措施執(zhi)行情(qing)況(kuang)(kuang)信(xin)(xin)息(xi)(xi)(包括(kuo)農村(cun)危房改造(zao)政策(ce)、對象(xiang)認定過(guo)程(cheng)(cheng)、補助資(zi)金(jin)分(fen)配、改造(zao)結果(guo));在(zai)住房分(fen)配方(fang)面,主(zhu)要公開(kai)保(bao)(bao)障性(xing)住房分(fen)配政策(ce)、分(fen)配對象(xiang)、分(fen)配房源(yuan)、分(fen)配程(cheng)(cheng)序、分(fen)配過(guo)程(cheng)(cheng)、分(fen)配結果(guo)等信(xin)(xin)息(xi)(xi)。
2.國(guo)有(you)土(tu)地使(shi)用權(quan)出讓(rang)(rang)領域。主要公開(kai)土(tu)地供應計劃、出讓(rang)(rang)公告、成交公示(shi)、供應結果等信息。
3.礦業權出讓(rang)領域(yu)。主要公(gong)開出讓(rang)公(gong)告公(gong)示、審批結果信(xin)息(xi)、項(xiang)目(mu)信(xin)息(xi)等信(xin)息(xi)。
4.政(zheng)府采(cai)購(gou)領域。主要公(gong)開采(cai)購(gou)項目(mu)公(gong)告、采(cai)購(gou)文件、采(cai)購(gou)項目(mu)預算金(jin)額、采(cai)購(gou)結果、采(cai)購(gou)合(he)同等(deng)采(cai)購(gou)項目(mu)信(xin)息,財政(zheng)部門作出的(de)投訴和監督檢(jian)查等(deng)處(chu)理決(jue)定、對集中采(cai)購(gou)機(ji)構的(de)考核結果,違法失信(xin)行為記錄等(deng)監督處(chu)罰信(xin)息。
5.國有產(chan)權交(jiao)易領(ling)域。除涉及(ji)商業秘密(mi)外(wai),主要公開(kai)產(chan)權交(jiao)易決(jue)策及(ji)批準(zhun)信(xin)息、交(jiao)易項目信(xin)息、轉讓價格、交(jiao)易價格、相關(guan)中介機構審計(ji)結果等信(xin)息。
6.工程建(jian)設項(xiang)(xiang)目(mu)招(zhao)(zhao)標(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)領(ling)域(yu)。主要(yao)公(gong)開依法必(bi)須(xu)招(zhao)(zhao)標(biao)(biao)(biao)項(xiang)(xiang)目(mu)的審批核(he)準(zhun)備案信息、市場主體信用等信息。除涉及(ji)國家(jia)秘(mi)密、商(shang)業秘(mi)密外,招(zhao)(zhao)標(biao)(biao)(biao)公(gong)告(包括招(zhao)(zhao)標(biao)(biao)(biao)條(tiao)件、項(xiang)(xiang)目(mu)概況與招(zhao)(zhao)標(biao)(biao)(biao)范圍、投(tou)標(biao)(biao)(biao)人資(zi)格要(yao)求(qiu)、招(zhao)(zhao)標(biao)(biao)(biao)文件獲取、投(tou)標(biao)(biao)(biao)文件遞交(jiao)等)、中(zhong)標(biao)(biao)(biao)候(hou)選(xuan)(xuan)人(包括中(zhong)標(biao)(biao)(biao)候(hou)選(xuan)(xuan)人排(pai)序、名稱(cheng)、投(tou)標(biao)(biao)(biao)報(bao)價、工期(qi)、評標(biao)(biao)(biao)情況、項(xiang)(xiang)目(mu)負責人、個人業績、有關證書及(ji)編號、中(zhong)標(biao)(biao)(biao)候(hou)選(xuan)(xuan)人在(zai)投(tou)標(biao)(biao)(biao)文件中(zhong)填報(bao)的資(zi)格能(neng)力條(tiao)件、提(ti)出異(yi)議的渠道和方式等)、中(zhong)標(biao)(biao)(biao)結(jie)果、合同訂(ding)立及(ji)履行等信息都(dou)應向(xiang)社會(hui)公(gong)布(bu)。
(二(er))明(ming)確公開主(zhu)體。
按(an)(an)照(zhao)“誰(shui)批準、誰(shui)公(gong)(gong)(gong)開(kai)(kai),誰(shui)實施、誰(shui)公(gong)(gong)(gong)開(kai)(kai),誰(shui)制(zhi)作、誰(shui)公(gong)(gong)(gong)開(kai)(kai)”的(de)(de)(de)原則(ze),公(gong)(gong)(gong)共資(zi)源(yuan)(yuan)配(pei)置涉及行政審批的(de)(de)(de)批準結(jie)果信(xin)息(xi)(xi)由(you)審批部(bu)門(men)負責公(gong)(gong)(gong)開(kai)(kai);公(gong)(gong)(gong)共資(zi)源(yuan)(yuan)項目基(ji)本信(xin)息(xi)(xi)、配(pei)置(交易)過程信(xin)息(xi)(xi)、中標(成交)信(xin)息(xi)(xi)、合同履約信(xin)息(xi)(xi)由(you)管理或實施公(gong)(gong)(gong)共資(zi)源(yuan)(yuan)配(pei)置的(de)(de)(de)國家機關、企事業單(dan)位(wei)按(an)(an)照(zhao)掌握信(xin)息(xi)(xi)的(de)(de)(de)情(qing)況分(fen)別公(gong)(gong)(gong)開(kai)(kai)。此外,探索建立公(gong)(gong)(gong)共資(zi)源(yuan)(yuan)配(pei)置“黑名單(dan)”制(zhi)度,逐步把騙取公(gong)(gong)(gong)共資(zi)源(yuan)(yuan)等不(bu)良行為的(de)(de)(de)信(xin)息(xi)(xi)納入“黑名單(dan)”,相(xiang)關信(xin)息(xi)(xi)由(you)負責管理的(de)(de)(de)部(bu)門(men)分(fen)別公(gong)(gong)(gong)開(kai)(kai)。
(三)拓寬公開(kai)渠道。
充分發(fa)揮(hui)政府網(wang)站第一平臺(tai)作用,及時發(fa)布(bu)公(gong)(gong)共(gong)(gong)資(zi)源配置(zhi)領(ling)域各類信(xin)(xin)(xin)息(xi),暢(chang)通(tong)依申請公(gong)(gong)開(kai)渠(qu)道。積極(ji)利用政務微博微信(xin)(xin)(xin)、新聞媒體(ti)(ti)、政務客戶端等拓寬信(xin)(xin)(xin)息(xi)公(gong)(gong)開(kai)渠(qu)道,開(kai)展(zhan)在線服務,提升用戶體(ti)(ti)驗。構建(jian)以(yi)全(quan)國(guo)(guo)(guo)公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易平臺(tai)為樞紐的(de)公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易數據共(gong)(gong)享(xiang)(xiang)(xiang)(xiang)平臺(tai)體(ti)(ti)系,推動實現(xian)公(gong)(gong)共(gong)(gong)資(zi)源配置(zhi)全(quan)流程透(tou)明化,各類依法應當公(gong)(gong)開(kai)的(de)公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易公(gong)(gong)告(gao)、資(zi)格審(shen)查結果、交(jiao)(jiao)(jiao)易過程信(xin)(xin)(xin)息(xi)、成交(jiao)(jiao)(jiao)信(xin)(xin)(xin)息(xi)、履約(yue)信(xin)(xin)(xin)息(xi)以(yi)及有關變更信(xin)(xin)(xin)息(xi)等在指定媒介發(fa)布(bu)后,要(yao)與(yu)相應的(de)公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易平臺(tai)實現(xian)信(xin)(xin)(xin)息(xi)共(gong)(gong)享(xiang)(xiang)(xiang)(xiang),并(bing)(bing)實時交(jiao)(jiao)(jiao)互(hu)至(zhi)全(quan)國(guo)(guo)(guo)公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易平臺(tai)匯總發(fa)布(bu)。公(gong)(gong)共(gong)(gong)資(zi)源配置(zhi)領(ling)域的(de)信(xin)(xin)(xin)用信(xin)(xin)(xin)息(xi)要(yao)同時交(jiao)(jiao)(jiao)互(hu)至(zhi)全(quan)國(guo)(guo)(guo)信(xin)(xin)(xin)用信(xin)(xin)(xin)息(xi)共(gong)(gong)享(xiang)(xiang)(xiang)(xiang)平臺(tai),并(bing)(bing)依托“信(xin)(xin)(xin)用中國(guo)(guo)(guo)”網(wang)站及時予以(yi)公(gong)(gong)開(kai)。要(yao)把公(gong)(gong)共(gong)(gong)資(zi)源交(jiao)(jiao)(jiao)易平臺(tai)與(yu)其他(ta)政務信(xin)(xin)(xin)息(xi)系統進行整合(he)共(gong)(gong)享(xiang)(xiang)(xiang)(xiang),實現(xian)公(gong)(gong)共(gong)(gong)資(zi)源配置(zhi)信(xin)(xin)(xin)息(xi)與(yu)其他(ta)政務信(xin)(xin)(xin)息(xi)資(zi)源共(gong)(gong)享(xiang)(xiang)(xiang)(xiang)銜接。
(四(si))強化公開時效。
堅持(chi)以(yi)公(gong)開(kai)為(wei)常態、不公(gong)開(kai)為(wei)例外(wai),公(gong)共資源配(pei)置(zhi)過程中(zhong)產生的政(zheng)(zheng)府(fu)信(xin)(xin)息(xi),除(chu)涉(she)及國家秘密、商業秘密等內(nei)容外(wai),應(ying)依法(fa)及時予以(yi)公(gong)開(kai)。確定(ding)(ding)為(wei)主動公(gong)開(kai)的信(xin)(xin)息(xi),除(chu)法(fa)律法(fa)規另有規定(ding)(ding)外(wai),要嚴(yan)格按照(zhao)《中(zhong)華人民共和國政(zheng)(zheng)府(fu)信(xin)(xin)息(xi)公(gong)開(kai)條例》規定(ding)(ding),自政(zheng)(zheng)府(fu)信(xin)(xin)息(xi)形成或變更之(zhi)日起(qi)20個(ge)工作日內(nei)予以(yi)公(gong)開(kai),行(xing)政(zheng)(zheng)許可、行(xing)政(zheng)(zheng)處(chu)罰事(shi)項應(ying)自作出行(xing)政(zheng)(zheng)決定(ding)(ding)之(zhi)日起(qi)7個(ge)工作日內(nei)上網公(gong)開(kai)。對于政(zheng)(zheng)府(fu)信(xin)(xin)息(xi)公(gong)開(kai)申(shen)請(qing),要嚴(yan)格按照(zhao)法(fa)定(ding)(ding)時限和理由(you)予以(yi)答復。
三、保障措施
(一)強(qiang)化組織領(ling)導。
各級政(zheng)(zheng)(zheng)府和(he)有(you)關部門(men)要高度重視公(gong)(gong)(gong)共(gong)資(zi)源(yuan)(yuan)配置領域的政(zheng)(zheng)(zheng)府信(xin)息(xi)公(gong)(gong)(gong)開(kai)工(gong)(gong)作(zuo)(zuo),加強組織領導,狠抓任(ren)務(wu)落(luo)實,以此作(zuo)(zuo)為(wei)深(shen)化政(zheng)(zheng)(zheng)務(wu)公(gong)(gong)(gong)開(kai)工(gong)(gong)作(zuo)(zuo)的有(you)效(xiao)抓手。各級政(zheng)(zheng)(zheng)府要建立健全協調機制(zhi),明(ming)確分工(gong)(gong),夯實責(ze)任(ren),政(zheng)(zheng)(zheng)府辦公(gong)(gong)(gong)廳(室)作(zuo)(zuo)為(wei)組織協調部門(men),要會(hui)同發展改(gai)革、工(gong)(gong)業和(he)信(xin)息(xi)化、財政(zheng)(zheng)(zheng)、國土(tu)資(zi)源(yuan)(yuan)、環保、住房城(cheng)鄉建設、交通(tong)運(yun)輸、水利、農(nong)業、商務(wu)、衛生計生、審計、國有(you)資(zi)產監(jian)督(du)管理、稅務(wu)、林業、鐵路(lu)、民(min)航等部門(men)以及(ji)公(gong)(gong)(gong)共(gong)資(zi)源(yuan)(yuan)交易相關監(jian)管機構,提出明(ming)確工(gong)(gong)作(zuo)(zuo)目(mu)標(biao)和(he)具(ju)體(ti)工(gong)(gong)作(zuo)(zuo)安(an)排(pai),認真(zhen)組織實施(shi)并做好政(zheng)(zheng)(zheng)務(wu)輿情(qing)監(jian)測和(he)回(hui)應(ying),確保任(ren)務(wu)逐項得到落(luo)實。
(二(er))加(jia)強監(jian)督檢查。
各級(ji)政(zheng)(zheng)府要定期對公(gong)(gong)(gong)共資(zi)源配置領域(yu)政(zheng)(zheng)府信(xin)(xin)息公(gong)(gong)(gong)開(kai)工作(zuo)進行(xing)檢查,主要包括政(zheng)(zheng)府信(xin)(xin)息公(gong)(gong)(gong)開(kai)情況、公(gong)(gong)(gong)開(kai)時效、交易平臺掌握信(xin)(xin)息報(bao)送和公(gong)(gong)(gong)開(kai)情況等。各有(you)關部(bu)門每(mei)年(nian)要將本領域(yu)工作(zuo)進展情況報(bao)同(tong)級(ji)政(zheng)(zheng)務公(gong)(gong)(gong)開(kai)主管部(bu)門,并在政(zheng)(zheng)府信(xin)(xin)息公(gong)(gong)(gong)開(kai)年(nian)度報(bao)告(gao)中公(gong)(gong)(gong)布,接受社(she)會公(gong)(gong)(gong)眾、新聞媒體(ti)的監(jian)督(du)。
(三)做好(hao)考核評估。
地(di)方各級政(zheng)府要(yao)按照(zhao)(zhao)政(zheng)務公(gong)(gong)開(kai)工作(zuo)績效考核(he)相(xiang)關規定,把(ba)公(gong)(gong)共資源配置(zhi)領域政(zheng)府信息公(gong)(gong)開(kai)工作(zuo)納入(ru)政(zheng)務公(gong)(gong)開(kai)工作(zuo)績效考核(he)范(fan)圍,加大考核(he)力度,并探索引入(ru)第三方評(ping)估機制(zhi),推動工作(zuo)有效開(kai)展(zhan)。建立健全激勵約(yue)束機制(zhi),對未按照(zhao)(zhao)相(xiang)關規定和要(yao)求履(lv)行公(gong)(gong)開(kai)職(zhi)責的(de),要(yao)通(tong)報批評(ping),并在年度考核(he)中予以體現;對工作(zuo)成效突出(chu)的(de),給(gei)予通(tong)報表(biao)揚。
