新華社北京(jing)1月4日(ri)電 國務(wu)(wu)院總理(li)李克強日(ri)前簽(qian)署國務(wu)(wu)院令,公(gong)布(bu)(bu)修訂后的(de)《食鹽專(zhuan)營辦法(fa)》(以下簡稱(cheng)《辦法(fa)》),自公(gong)布(bu)(bu)之日(ri)起施行(xing)。1990年3月2日(ri)國務(wu)(wu)院發布(bu)(bu)的(de)《鹽業管理(li)條例》同時(shi)廢止(zhi)。
鹽業(ye)(ye)是(shi)我國(guo)重要(yao)(yao)的(de)(de)基(ji)礎性行(xing)業(ye)(ye),食(shi)鹽事關人民群(qun)眾身體(ti)(ti)健康。黨中(zhong)央和國(guo)務(wu)院(yuan)(yuan)高度(du)重視鹽業(ye)(ye)體(ti)(ti)制(zhi)改革(ge)工(gong)作,2016年4月,《國(guo)務(wu)院(yuan)(yuan)關于印(yin)發(fa)鹽業(ye)(ye)體(ti)(ti)制(zhi)改革(ge)方(fang)案(an)的(de)(de)通知》提出在堅持食(shi)鹽專營制(zhi)度(du)的(de)(de)基(ji)礎上,推(tui)進(jin)供(gong)給側結構性改革(ge);要(yao)(yao)求實(shi)現鹽業(ye)(ye)資源有效配置,進(jin)一步釋放市場(chang)活力。為保障鹽業(ye)(ye)體(ti)(ti)制(zhi)改革(ge)順利進(jin)行(xing),按(an)照(zhao)國(guo)務(wu)院(yuan)(yuan)部署,對原《食(shi)鹽專營辦法》作了修訂。
根據鹽(yan)(yan)(yan)業(ye)體制改革(ge)方案關(guan)于堅(jian)持食(shi)(shi)(shi)鹽(yan)(yan)(yan)專(zhuan)(zhuan)營制度、改革(ge)食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)價(jia)機制和取(qu)消(xiao)食(shi)(shi)(shi)鹽(yan)(yan)(yan)產、運、銷等環(huan)節計劃管(guan)(guan)理(li)的(de)規定(ding),《辦法(fa)》對食(shi)(shi)(shi)鹽(yan)(yan)(yan)專(zhuan)(zhuan)營制度的(de)具(ju)體內容作了完善。一是省級(ji)鹽(yan)(yan)(yan)業(ye)主(zhu)管(guan)(guan)部(bu)門按(an)照統(tong)一規劃、合理(li)布(bu)局的(de)要求,審批(pi)(pi)確(que)定(ding)食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)生產、定(ding)點(dian)批(pi)(pi)發(fa)(fa)(fa)(fa)企(qi)業(ye)。二是食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)生產企(qi)業(ye)申請經(jing)營食(shi)(shi)(shi)鹽(yan)(yan)(yan)批(pi)(pi)發(fa)(fa)(fa)(fa)業(ye)務的(de),省級(ji)鹽(yan)(yan)(yan)業(ye)主(zhu)管(guan)(guan)部(bu)門應當(dang)確(que)定(ding)其為食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)批(pi)(pi)發(fa)(fa)(fa)(fa)企(qi)業(ye)并頒(ban)發(fa)(fa)(fa)(fa)食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)批(pi)(pi)發(fa)(fa)(fa)(fa)企(qi)業(ye)證(zheng)(zheng)書;食(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)批(pi)(pi)發(fa)(fa)(fa)(fa)企(qi)業(ye)在國家(jia)規定(ding)的(de)范圍(wei)內銷售食(shi)(shi)(shi)鹽(yan)(yan)(yan),任何單位或者(zhe)個人不得阻止(zhi)或者(zhe)限制;食(shi)(shi)(shi)鹽(yan)(yan)(yan)價(jia)格由經(jing)營者(zhe)自主(zhu)確(que)定(ding)。三是刪除了原《食(shi)(shi)(shi)鹽(yan)(yan)(yan)專(zhuan)(zhuan)營辦法(fa)》關(guan)于食(shi)(shi)(shi)鹽(yan)(yan)(yan)生產、批(pi)(pi)發(fa)(fa)(fa)(fa)、分配調撥、運輸(shu)等實行指令性計劃管(guan)(guan)理(li),以及(ji)核發(fa)(fa)(fa)(fa)食(shi)(shi)(shi)鹽(yan)(yan)(yan)準運證(zheng)(zheng)的(de)規定(ding)。
《辦法》完善了食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)供應安全的制(zhi)度,規定(ding)省級鹽(yan)(yan)(yan)業主管(guan)部(bu)(bu)門(men)建立健全食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)儲(chu)備制(zhi)度,承(cheng)擔政府食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)儲(chu)備責任;食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)定(ding)點(dian)(dian)生產、定(ding)點(dian)(dian)批發(fa)(fa)企業承(cheng)擔企業食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)儲(chu)備責任,保持食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)的合理庫存;縣級以(yi)上地方人民(min)政府采取必要(yao)措施,保障(zhang)邊遠地區和民(min)族地區的食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)供應。鹽(yan)(yan)(yan)業主管(guan)部(bu)(bu)門(men)應當(dang)會同有關部(bu)(bu)門(men)制(zhi)定(ding)食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)供應應急(ji)預(yu)案,在發(fa)(fa)生突發(fa)(fa)事件時,協調、保障(zhang)食(shi)(shi)(shi)(shi)(shi)鹽(yan)(yan)(yan)供應。
《辦法》強化了食(shi)(shi)(shi)鹽(yan)(yan)質量安(an)全的(de)(de)管(guan)(guan)(guan)控措(cuo)施(shi),在規定鹽(yan)(yan)業主管(guan)(guan)(guan)部門負責管(guan)(guan)(guan)理(li)食(shi)(shi)(shi)鹽(yan)(yan)專營工作(zuo)基礎(chu)上(shang),增加規定國務院食(shi)(shi)(shi)品(pin)藥品(pin)監管(guan)(guan)(guan)部門和(he)縣級(ji)(ji)以(yi)上(shang)地方(fang)人民政(zheng)府(fu)確定的(de)(de)部門負責食(shi)(shi)(shi)鹽(yan)(yan)質量安(an)全監督(du)管(guan)(guan)(guan)理(li);增加對食(shi)(shi)(shi)鹽(yan)(yan)企業及其(qi)董事、監事、高(gao)級(ji)(ji)管(guan)(guan)(guan)理(li)人員的(de)(de)信(xin)(xin)用管(guan)(guan)(guan)理(li),建立(li)健全信(xin)(xin)用信(xin)(xin)息記錄(lu)和(he)公(gong)示制度的(de)(de)規定;明確禁止銷售不符合食(shi)(shi)(shi)品(pin)安(an)全標準的(de)(de)食(shi)(shi)(shi)鹽(yan)(yan),完善(shan)了禁止作(zuo)為食(shi)(shi)(shi)鹽(yan)(yan)銷售的(de)(de)產品(pin)類別;進(jin)一(yi)步(bu)完善(shan)法律責任,加大(da)對違(wei)法行為處罰力度。
